1. Definitions
1.1. “Ace IT Support” means its proprietor and its authorised representatives.
1.2. “Customer” means person/s buying goods from Ace IT Support.
1.3. “Goods” mean all products and services supplied by Ace IT Support to the customer.
1.4. In these terms and conditions, “we” “us” “our” refers to Ace IT Support and “You" refers to customer.
2. Site Access
2.1. When you visit our website, we give you a limited licence to access and use our information.
2.2. Under the Copyright Act 1968 (Cth), you are not permitted to copy, reproduce, republish, distribute or display any of the
information on this website without our prior written permission.
2.3. The licence to access our website does not include the right to use any data mining robots or other extraction tools. The licence also does not permit
you to metatag or mirror our website without our prior written permission. We reserve the right to serve you with notice if we become aware of your metatag
or mirroring of our website.
2.4. Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase our goods, you acknowledge that you are over
18 years of age.

3.1. This website may from time to time contain hyperlinks to other websites. Such links are provided for convenience only and we take
no responsibility for the content and maintenance of or privacy compliance by any linked website. Any hyperlink on our website to another
website does not imply our endorsement, support, or sponsorship of the operator of that website nor of the information and/or products which they provide.

4.1. The copyright to all content on this website including applets, graphics, images, layouts and text belongs to us or we have a licence to use those materials.
4.2. All trademarks, brands and logos which are used on this website are either owned by us or we have a licence to use them. Your access to our website does not

5. Product Descriptions
5.1. We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate.
Where we become aware of any misdescription, we reserve the right to correct any error or omission.
5.2. Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given
image will reflect or portray the full design or options relating to that product.
5.3. We quote speeds and other performance data. Please note that these quotes are only for comparative purposes
and your actual speed or other performance can vary with a host of factors, including other equipment or phone line used.
6. Product Orders
6.1. We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website.
6.2. All prices are in Australian Dollars (AUD) and are excluding GST. We endeavour to ensure that our price
list is current. Our price list can be accessed from our home page and we reserve the right to amend our prices at any time.
If you have placed an order, we reserve the right to cancel your order should our prices change.
6.3. Packaging and postage is an additional charge, calculated at time of purchase.
6.4. When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details.
We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due
to error in transmission or virus or malware.
6.5. We undertake to accept or reject your order within 5 business days. If we have not responded to you within 5 business days,
your offer is deemed to be rejected. We are not required to give reasons for rejecting your offer to purchase however the most likely reason for rejecting your
offer will be that we do not currently have that product in stock.
6.6. Once you have submitted an order, you may not cancel that order even if our acceptance or rejection of your offer is still pending.
6.7. Delivery of your ordered product/s will be as set out on our website or sales quotation. Title in the goods passes to you when we have received payment.
6.8. All risk of loss or damage to the goods passes to you when we despatch the goods. At the time of conducting your transaction we give you the option to
take out carrier insurance.
7. Order Cancellation Due To Error
7.1. Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to typographical error
or similar oversight, we reserve the right to cancel a transaction. Where your credit card has been charged, we will immediately refund your
credit card for the total amount debited.
8. Product Returns
8.1. We undertake to replace any product delivered to you that is faulty or is in a damaged condition. If we are unable at the time of return to replace or exchange returned goods, we undertake to reimburse the amount initially debited for the purchase excluding packaging and postage charges. If you wish to return a faulty or damaged product, you must notify us through our designated “contact” webpage.
8.2. If you wish to return an item because you have changed your mind or not satisfied with your purchase, Ace IT Support will offer you exchange, credit or refund provided that:
a.You return the item within 7 days of purchase.
b.Provide proof of purchases at the time you return the item.
c.Item is in re-saleable condition it is in its original packaging, including manuals and accessories. It is undamaged and it it not an on-sale item.
8.3. A minimum restocking fee of 20% on each item will be applied based on the condition and age of the returned product.
8.4. Ace IT Support reserves the right to assess the condition and age of returned products prior to providing a repair, exchange or refund. This may result in a repair, exchange or refund being refused.
8.5. Postage and handling costs are not refundable for returns, and any postage costs to return items back to us are paid by the customer.
9. Repair/maintenance Service
9.1. We shall make all efforts to ensure that the device is repaired by estimated timeframe. However, at times due to non-availability / shortage of
critical spare parts or complicated fault, the repair turnaround time may take longer as mentioned herein. Cut-off time apply for same day service.
Guarantee timing begins once the device is received at the workshop.
9.2. We endeavour to diagnose and where possible resolve the problem as described by you, the customer. If any hardware or software is required, this may
incur a fee additional to the quoted price. Any further problems, deemed by the technician to be unrelated may warrant a charge additional to the quoted price.
Should the final expected charge be more than initial estimate, we will proceed only after taking the approval (either in writing or on phone) from customer.
In the event final estimate is not approved by the customer within 5 days, the device will be returned to the customer in the condition existing after
carrying out the detailed inspection and we will not be responsible for the device whatsoever.
9.3. You agree that the device is not operating at full functionality and therefore you not hold us liable for any incidental,
consequential or indirect damages (including but not limited to hardware faults, damages for loss of data, loss of program,
or service interruptions) that may rise from the repair service of your device or the transportation of your equipment.
9.4. It is customer responsibility to save or backup the device data prior to repair. We provide backup service at additional
charge, however we do not guarantee the integrity of data.
9.5. Ace IT Support shall not be obliged to undertake any repairs found to be tampered as a result of repair carried out by unprofessional repairer.
9.6. In case a device becomes defective while the same is being repaired and cannot be brought back to the original condition
in which the device was delivered to us for repairs, in such event, Ace IT Support shall not be liable for the device becoming defective and
shall not be required or called upon by the customer to pay any compensation for the same.
10. Warranty
10.1. Repair service provided by us carry warranty for the same fault from the date of handing over of the device to the customer.
In event of a problem with workmanship, we must be notified within 7 days of accepting delivery and return the device to workshop for inspection.
Under such circumstance we provide again or rectify any part of them that are defective. It is your responsibility to inspect the device within this
timeframe, otherwise warranty may be void.
10.2. For product sold, we give you a warranty at the time of supply. During the warranty period if the product becomes defective, we will repair
or replace the device or any part of it at our discretion. Software and software configuration are not covered by warranty.
10.3. Claims for warranty that are found to fall outside of the warranty will attract a diagnostic fee that is payable prior to taking delivery by customer.
10.4. To make a Warranty claim, you must;
a. Contact phone number listed at our designated “contact” webpage.
b. Return the device at the workshop with a copy of your receipt. Additional charges apply if the device needs to be picked up from customer’s location.
11. Warranty Exclusion
11.1. The warranty will not apply if during the warranty period;
a. Deliberate or accidental damage;
b. Neglect or modification;
c. Operation/storage outside the environmental limits;
d. Incorrect voltage or a power surge;
e. Your use of any non-genuine consumables, software, parts, accessories or interfacing.
12. Payment
12.1. The Customer shall take delivery of the device within 5 days of intimation from us.
This shall be regardless whether the device has been repaired or not. In case the customer fails to pay the Charges to Ace IT Support at
the time of delivery of the device, we reserve the right to retain the said device till such time the Charges have been paid by the customer to us.
12.2. In the event customer does not take the delivery within 30 days will result in cost recovery
sought by the disposal of the device and by other methods at the discretion of Ace IT Support. We reserve the right to recover
from the customer any deficit amount post such sale / auction of the device.
13. Promotions
13.1. Customer is required to specify the promotional offer when requesting a quote otherwise the promotion may not be applied.
13.2. Individual offers cannot be used in conjunction with other promotions. Ace IT Support reserves right to change, amend,
add or delete any of the promotion without prior notice.
14. Force Majeure
14.1. If a Force Majeure event causing delay continues for more than 30 days, we may terminate this Agreement by giving at least 3 days’
Notice to you. “Force Majeure” means any act, circumstance or omission over which we could not reasonably have exercised control.
15. Indemnity
15.1. You agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising in connection
with your use of our website.
16. Limitation of Liability
16.1. If you are not a consumer then this clause applies to you;
i.To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of
the services again or payment of the costs of having those services supplied again.
ii. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services we have supplied.
iii. We do not accept liability for anything contained in the post of a user or in any form of communication which originates with a user and not with Us.
iv. We do not participate in any way in the transactions between our users in our website or at any other social media such as our company Facebook page.
17. Disclaimers
17.1. We take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any
damage to your computer system which arises in connection with your use of our website or any linked website.
18. Privacy
18.1. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
